This website is operated by Marine Serre SARL. Throughout the site, the terms “we”, “us” and “our” refer to MARINE SERRE SARL. MARINE SERRE SARL offers this website, including all information, tools and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.

By visiting our site and/ or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. 1.1. These general terms of sale (hereinafter “GTS”) relate to the placing, fulfilment and processing of orders from the www.marineserre.com website.

They form a contract between the Customer (defined below in clause 1.2) and MARINE SERRE SARL.

MARINE SERRE SARL, which is headquartered at 134-140, rue d’Aubervilliers 75019 PARIS, email address: onlinestore@marineserre.com, SIREN number: 831 321 450, operates the website with the address www.marineserre.com, an online sales website for clothing and accessories.

1.2. These GTS apply solely to adult individuals who are not traders and who have full legal capacity to enter into contracts.

As a consumer, the Customer has specific rights which would be compromised if products purchased on the www.marineserre.com website were connected with their professional activity.

1.3. The Customer is invited to keep/save a copy. They may save or edit these general terms using the standard functions of their browser or computer.

2.1. The MARINE SERRE SARL GTS are solely applicable to any order placed on the www.marineserre.com website and are agreed to by the Customer during the ordering process.

2.2. By confirming an order, the Customer indicates that they unreservedly agree to the terms of the order and the entirety of these general terms of sale.

The consumer acknowledges that they are fully aware that they need not sign this document by hand in order to indicate their agreement to the contents of these general terms, and merely placing an order indicates acceptance.

2.3. MARINE SERRE SARL reserves the right to amend the GTS at any time by publishing a new version thereof on the www.marineserre.com website. The applicable GTS shall be those in force on the date when the order is confirmed.

The different versions of the GTS shall be archived by MARINE SERRE SARL. The consumer may request a copy of archived previous versions of the GTS, but must state the date of their request.

2.4. The GTS are applicable to orders placed for delivery in metropolitan France including Corsica, and abroad [KV1] [A2] [BL3].

2.5. These GTS shall apply from the date of confirmation of the order and shall remain applicable until the Company’s guarantees and obligations cease.

3.1. In accordance with Article L111-1 of the Consumer Code, the products offered for sale by MARINE SERRE SARL shall be those that appear on the website on the day when the website is viewed by the Customer subject to availability of stock, and the Customer may, before ordering, find out the essential characteristics of the product(s) that they wish to order.

3.2. While every effort is made to ensure that photos, graphic representations and texts which are reproduced in order to illustrate presented products give as accurate a reflection of them as possible, variations may arise due to the available technologies and the manufacturing methods used. The consumer cannot make complaints about this to the extent that such variations do not relate to essential characteristics of the item sold.

3.3. The items offered for online sale on the www.marineserre.com website comply with regulations in force in France. MARINE SERRE SARL cannot be held liable for non-compliance with the laws of a third country.

Article 4 – Online orders

The Company undertakes to fulfil orders subject to availability of stock.

4.1. The ordering process consists of the following stages:

Stage 1: searching for and choosing a product;

Stage 2: selecting a product;

Stage 3: checking the details of the order, the total price and correcting any errors;

Stage 4: confirming the basket and confirming the order;

Stage 5: creating a customer account and entering the Customer’s personal details. A customer account is strictly personal and must not be disclosed in any circumstances.

Stage 6: approval of the delivery method (if several methods are offered);

Stage 7: reading and agreeing to the GTS;

Stage 8: choosing the payment method and paying for the order.

4.2. Where an order cannot be fulfilled, the Customer shall be informed by email and may cancel their order.

4.3. Delivery charges are as follows:

- Free delivery if at least EUR 400 is spent

- Australia: EUR 35

- European Union: Between EUR 10 and EUR 35

- United Kingdom: EUR 15

- USA and Canada: EUR 35

- Rest of world: +/- EUR 35

4.4. Any order placed on the www.marineserre.com website is only finally confirmed at the end of the process of checking the Customer’s payment. Note that the presence of an item in a basket does not constitute a purchase or reservation.

4.5. An order confirmation email acknowledging receipt of the items ordered is automatically sent to the Customer where the latter has confirmed and then paid for their order.

4.6. The consumer confirms that the information provided is truthful and accurate.

MARINE SERRE SARL cannot be held liable for adverse consequences of errors on the part of the buyer when providing their email address.

4.7. MARINE SERRE SARL reserves the right to reject an order for any legitimate reason such as failure to pay, problems in the buyer’s account, or a dispute with the Customer over payment for a previous order.

5.1. Prices of products are stated in euros and are inclusive of value-added tax (VAT, which is between 19% and 27% of the total value of the order).

Prices include value-added tax (VAT) applicable on the date of the order and any changes in the applicable rate will automatically be reflected in the prices of products sold by MARINE SERRE SARL on its website.

5.2. Prices do not include associated costs, customs clearance in the event of overseas delivery, bank charges or any other costs payable by the Customer.

Product prices also do not include Internet access costs, which are payable by the consumer.

5.3. MARINE SERRE SARL reserves the right to change its prices at any time, but undertakes to apply the prices in force indicated at the time of ordering, subject to availability on that date.

5.4. Any order placed on the website for delivery outside the European Union may be subject to customs duties and any taxes charged when the parcel reaches its destination. Such dues are payable solely by the Customer and the latter bears full responsibility for both declaration and payment to the relevant authorities. MARINE SERRE SARL has no obligation to check and inform its customers of the applicable customs duties and taxes. To find out what they are, the Customer must make enquiries to the relevant authorities in the country of delivery.

5.5. Ownership of ordered products shall only be transferred once payment has been made.

If you decide to refuse to pay the tax and return the parcel, please note that we will deduct from your refund any import duties related to your return.

6.1. The Customer can pay for their order:

by bank card (Visa, Mastercard or debit card).

6.2. In order to make payment by bank card, the Customer is invited to fill in their card number, the expiry date, the holder’s name and the security number (on the back of the card). Depending on the Customer’s bank, additional information may be required.

6.3. Transactions are immediately debited from the Customer’s bank card after the card details have been checked and authorisation has been received from the card issuer. MARINE SERRE SARL reserves the right to refuse to make delivery if the Customer fails to pay and/or a clear case of fraud is identified.

6.4. MARINE SERRE SARL makes every effort to ensure that data sent via the website remains confidential and secure. Purchases are paid for through the secure payment platform of Caisse d’Epargne or the System Pay platform.

6.5. Payment transactions do not involve payment of any “payment on account” or deposit within the meaning of Article 1590 of the Civil Code; they are cash sales within the meaning of Article 1583 of the Civil Code.

6.6. The www.marineserre.com website allows the Customer to save their bank details for future purchases. To do so, the Customer must:

Pay for their most recent purchase in euros and by bank card on the www.marineserre.com website;

Enter their details (bank details entered on the payment page are encrypted and secure);

Tick the “Save my details for future payments” box on the card payment page;

Confirm the payment.

Once the payment has been confirmed, the delivery details (delivery address and method), billing details and details of the bank card used are recorded. The Customer’s bank details are kept not by MARINE SERRE SARL, but by its payment service provider, System Pay, on secure servers for up to 14 months after the date on which the saved card is debited. Once this period has ended, details are deleted.

The Customer can delete the details of their saved bank card and/or add another bank card at any time in “My account”.

6.7. The Customer can also choose to pay for their order via PayPal. After choosing this payment method, the Customer will be redirected to the PayPal website. They must enter their details and proceed with the payment.

When payment is made via PayPal, the Customer’s financial details are never passed on to MARINE SERRE SARL. This is because PayPal encrypts and protects the bank card number.

7.1. Delivery address: Items are delivered to the address given by the Customer during the purchase process. If there is an error in the Customer’s details, MARINE SERRE SARL cannot be held responsible for being unable to deliver the order. In this situation, the costs of redirecting the order shall be solely payable by the Customer.

7.2. Delivery methods: The Customer has a single delivery option for deliveries in metropolitan France and Europe via a carrier who makes express delivery 1 to 4 days after the order is dispatched. For deliveries to other countries, the Customer has an express delivery option offered by carriers who deliver 1 to 4 days after the order is dispatched.

7.3. Delivery times: Delivery times vary according to availability of stock and the Customer’s geographical location.

Items which are available in stock are delivered within 7 working days (on average, depending on the country) after the day when the order is confirmed. This includes confirmation of the order, order preparation and dispatch by the postal service or carrier.

7.4. Delivery charges:

- Delivery is free for purchases worth EUR 400 or more.

- Australia: EUR 35

- European Union: Between EUR 10 and 35

- United Kingdom: EUR 15

- USA and Canada: EUR 35

- Rest of world: EUR 35

7.5. Delayed delivery: MARINE SERRE SARL declines all responsibility for delivery delays attributable to the carrier. In the event of a delivery delay, the Customer is therefore advised to contact the carrier in the first instance to find out the delivery status of the parcel.

If the delivery time is not adhered to through the fault of MARINE SERRE SARL, the latter must inform the Customer by email that delivery will be made late. If delivery takes more than 4 weeks from the date of confirmation of the order, the Customer can cancel the order.

If the buyer is not at the address on the day of delivery, the delivery agent will drop a missed delivery note through the Customer’s letterbox which will enable the latter to pick up the parcel at the specified place and within the specified period.

7.6. Delivery tracking: The Customer will receive an email stating the parcel tracking number so that they can track the delivery of their order on the carrier’s website.

7.7. Checking of orders: The Customer must check the condition of the packaging at the time of delivery. If the original packaging is damaged, the Customer must express any reservations or complaints directly to the carrier or even reject the delivery. Complaints must be sent directly to the carrier and a copy must be sent to MARINE SERRE SARL.

8.1. The consumer has a right to cancel this contract without giving reasons within 14 days.

The cancellation period ends 14 days after the day when the consumer, or a third party other than the carrier who is appointed by them, physically takes possession of the item. To exercise the right to cancel, the consumer must give notice via La Poste by registered letter to MARINE SERRE SARL, 134, rue d’Aubervilliers 75019 PARIS or by email to onlinestore@marineserre.com of their decision to cancel this contract, making an ambiguous statement to this effect. The consumer may use the specimen cancellation form below, but this is not mandatory. To be regarded as having met the deadline for cancellation, the consumer need merely send their request to exercise their right to cancel by the end of the cancellation period.

8.2. Under Article 221-28 of the Consumer Code, the aforementioned right to cancel does not apply to made-to-measure products.

8.3. The consumer must return the product to MARINE SERRE SARL without undue delay and, in all circumstances, no later than 14 days after giving notice of their decision to cancel this contract.

The cost of delivery for a first return or first exchange is payable by the Customer. The latter may then return the item(s) in its/their packaging.

8.4. Refunds shall be given no later than 14 days from the day when MARINE SERRE SARL is informed of the consumer’s decision to cancel. It can delay giving a refund until the item has been received, and shall use the same method of payment used by the consumer for the original transaction.

The return requirements set out in these GTS must be met in order for a refund to be given. If they are not adhered to, the Customer runs the risk that no refund will be given for the returned items.

8.5. Any item which is returned in a modified state or which has undergone alterations or been damaged, used or soiled by the Customer will not be exchanged or refunded. MARINE SERRE SARL shall decide at its sole discretion whether returned items are in satisfactory condition.

8.6. MARINE SERRE SARL reserves the right to reject any subsequent order if fraudulent, abnormal or excessive returns have occurred.

9.1. MARINE SERRE SARL is responsible for all of its obligations under this remotely made contract. However, the Company cannot be held liable where non-performance of its obligations is attributable to the Customer, an unforeseeable third-party act beyond its control, or a force majeure event.

9.2. MARINE SERRE SARL endeavours to maintain a high-quality website. However, due to the constraints inherent in running digital networks, the Company cannot guarantee that the www.marineserre.com website will be accessible continuously. As such, it cannot be held liable for nuisances or harm inherent in Internet use such as interruptions of service, intrusions from outside, the presence of computer viruses, or any event classed as force majeure by the courts.

Hypertext links may link to websites other than www.marineserre.com, which declines all responsibility for situations where the content of such websites is contrary to current legal and regulatory provisions.

9.3. MARINE SERRE SARL complies with the provisions of the Consumer Code and the Civil Code in relation to guarantees. These provisions are set out below:

Article L217-3 of the Consumer Code: The seller shall deliver an item that is compliant with the contract and the criteria set out in Article L. 217-5.

He shall be liable for non-conformities which exist at the time of delivery of the item within the meaning of Article L. 216-1 which come to light within two years following that time.

Article L217-5 of the Consumer Code: I.-In addition to the criteria relating to compliance with the contract, the item shall be compliant if it satisfies the following criteria:

1° It is fit for the use ordinarily expected of an item of the same type, taking into account, where necessary, any provisions of European Union law and national law and any technical standards or, in the absence of such technical standards, special codes of conduct that are applicable to the sector concerned;

2° Where applicable, it possesses the properties that the seller presented to the consumer in the form of a sample or model before the contract was entered into;

3° Any digital components that it may have are provided in the most recent version available when the contract is entered into, except where the parties agree otherwise;

4° Where applicable, it is delivered with all accessories, including packaging, and installation instructions which the consumer may reasonably expect;

5° Where applicable, it is provided with updates that the consumer may reasonably expect, as provided in Article L. 217-19;

6° It is consistent with the quantity and quality, and has the other characteristics, including in terms of durability, functionality, compatibility and safety, that the consumer may reasonably expect for items of the same type, having regard to the nature of the item and public statements made by the seller, by any person further up the chain of transactions, or by a person acting on their behalf, including in advertising or on labelling.

II.-However, the seller shall not be bound by any public statements mentioned in the previous paragraph if he can show:

1° That he did not know of them and could not reasonably have known of them;

2° That when the contract was entered into, the public statements had been corrected in a manner comparable to that in which the original statements were made; or

3° That the public statements could not have affected the decision to purchase.

III.-The consumer cannot dispute conformity by citing a defect relating to one or more particular characteristics of the item where he was specifically informed that they departed from the conformity criteria listed in this article and he explicitly and separately agreed to such departure when the contract was entered into.

Article L217-12 of the Consumer Code: The limitation period for legal actions over defects of conformity is two years from delivery of the item.

Article 1641 of the Civil Code: The seller is bound by the guarantee in relation to latent defects in sold goods which make them unfit for their intended purpose, or which restrict such use to such an extent that the buyer would not have bought them, or would only have paid a lower price, had he known of them.

Article 1648 para. 1 of the Civil Code: Actions over critical defects must be brought by the buyer within two years following discovery of the defect.

9.4. The law applicable to this contract is French law. Any disputes over the interpretation and performance of these general terms of sale shall be subject to French law.

10.1. The www.marineserre.com website, the services offered and all content, texts, databases, software and visual and audiovisual components thereof are the sole property of MARINE SERRE SARL and are protected by intellectual property law. Any reproduction is explicitly prohibited without the consent of MARINE SERRE SARL.

10.2. The MARINE SERRE mark is a registered trademark. No licence or permission to reproduce is granted in respect of the MARINE SERRE mark under these GTS.

11.1. Under Articles L213-1, D213-1 and D213-2 of the Consumer Code, MARINE SERRE SARL shall keep records of consumer orders with a value greater than or equal to EUR 120 for a period of ten (10) years following delivery of the order and shall give consumers access to them at any time during this period.

11.2. All computerised data relating to the consumer’s order shall be kept on MARINE SERRE SARL’s behalf in reasonably secure conditions.

12.3. For how long do we keep your data?

-Data necessary for order management and billing: for the entire duration of the business relationship and for 10 (ten) years in order to comply with accounting requirements (Article L123-22 of the Commercial Code).

-Data necessary for loyalty and prospecting activity: for the entire duration of the business relationship and for three (3) years from the last purchase.

-Details of payment methods: this data is not kept by MARINE SERRE; it is collected at the time of the transaction and is immediately deleted when the purchase is paid for.

12.3. For how long do we keep your data?

-Data necessary for order management and billing: for the entire duration of the business relationship and for 10 (ten) years in order to comply with accounting requirements (Article L123-22 of the Commercial Code).

-Data necessary for loyalty and prospecting activity: for the entire duration of the business relationship and for three (3) years from the last purchase.
